The Importance Of Filing Your Lis Pendens When Foreclosing A Construction Lien

By Daniel Morman, Esquire

The filing of a construction or mechanic’s lien is just one in a series of steps a contractor can take to protect its right to receive payment for labor and materials provided. Assuming that the contractor has properly followed the required steps before filing its claim of lien, and the contractor still has not received payment, the next step in most instances would be to foreclose the lien before the statute of limitations expires. Typically, when such an action is commenced, the party filing the suit also files a lis pendens (a notice of a pending suit). This device places everyone on notice that there is a dispute which involves title to a property. In effect, the lis pendens hamstrings the owner’s ability to sell or otherwise encumber the property until the dispute which resulted in the filing of the notice of lis pendens is resolved.

Hurricane Preparedness 2009

During certain months, tropical storms and hurricanes are a reality of life along our beautiful coast. It is important to be educated about these storms and the general terms associated with them.

If a tropical system forms during hurricane season, which runs from June through November, and you live in or have plans to visit the area, monitor reports from the National Oceanic and Atmospheric Administration’s (NOAA) National Hurricane Center at www.nhc.noaa.gov and the National Weather Service at www.srh.noaa.gov. Once a watch or a warning has been issued for the area, local hurricane information, such as evacuation notices, routes, and shelters, is always posted on the respective Counties and Cities  website.

Please take some time and go over the following Disaster Prevention provided by the National Hurricane Center:
»
Developing a Family Plan
»
Creating a Disaster Supply Kit
»
Having a Place to Go
»
Securing your Home
»
Having a Pet Plan

"Preventing the loss of life and minimizing the damage to property from hurricanes are responsibilities that are shared by all."

Life Lessons: The Mayonnaise Jar and the Coffee

When things in your life seem almost too much to handle; When 24 hours in a day are not enough;

Remember the mayonnaise jar... and the coffee...

A professor stood before his philosophy class and had some items in front of him. When the class began, wordlessly, he picked up a very large and empty mayonnaise jar and proceeded to fill it with golf balls. He then asked the students if the jar was full. They agreed that it was.

So the professor then picked up a box of pebbles and poured them into the jar. He shook the jar lightly. The pebbles rolled into the open areas between the golf balls. He then asked the students again if the jar was full. They agreed it was..

The professor next picked up a box of sand and poured it into the jar. Of course, the sand filled up everything else. He asked once more if the jar was full. The students responded with a unanimous "yes."

The professor then produced two cups of coffee from under the table and poured the entire contents into the jar, effectively filling the empty space between the sand. The students laughed.

"Now," said the professor, as the laughter subsided, " I want you to recognize that this jar represents your life.

The golf balls are the important things: God, family, your children, your health, your friends, and your favorite passions - things that if everything else was lost and only they remained, your life would still be full.

The pebbles are the other things that matter like your job, your house, and your car. The sand is everything else.....the small stuff.

"If you put the sand into the jar first," he continued, "there is no room for the pebbles or the golf balls.

The same goes for life. If you spend all your time and energy on the small stuff, you will never have room for the things that are important to you.

Pay attention to the things that are critical to your happiness. Play with your children. Take time to get medical checkups. Take your partner out to dinner. Play another 18. There will always be time to clean the house and fix the disposal. Take care of the things that really matter first.....the golf balls. Set your priorities. The rest is just sand."

One of the students raised her hand and inquired what the coffee represented. The professor smiled.

"I'm glad you asked. It just goes to show you that no matter how full your life may seem, there's always room for a couple of cups of coffee with a friend."

Father's Day celebration is just around the corner, specifically coming in the third week of June. Recommended gifts are being published in magazines and newspapers and are posted in numerous stores. But more than the tangible gifts that fathers receive, there is a more special gift that they are looking for - that could be Time.

We all know how much time they spent working just to earn a living for the family. Because of that, they forget to unwind and relax and enjoy the simplest things in life. A better way to remind them of the joys of living is to give them the time to experience such. A popular family activity that gives Time its true value is a picnic. Yes, a simple picnic and the time to be with the family. It creates the moment where the family laughs together, have fun together, and celebrate life together.

You can have this particular picnic dedicated to Dad. Just think about everything that is Dad's favorite - his favorite game, preferred activity, choice of food, much loved dessert, and his beloved members of his family. Fill your picnic basket with foods he loves to eat. Do not forget to bring his favorite dessert. Bring in energy bars so you can enjoy the whole day of playing and laughing.

Bring along materials needed for his desired game - be it football, Frisbee, or baseball. Include the whole family in whatever outdoor game you wish to play. You can also introduce your Dad to a new game.

But of course, be sure to give your Dad an outfit prior to going hiking or setting your picnic near the lake. You can always give him a good collared shirt or just a simple yet cool pair of socks for his summer outfit. If you plan to give extra gifts during the picnic, you can consider getting him an amazing set of grilling tools. You can cook yummy steaks during your picnic and Dad gets to show off his skills and new barbeque tools.

The main man in the house would surely appreciate even the littlest thing you do or give for them. Because they appreciate the time it took for you to plan the activity or search for that special gift. So take Dad to a picnic and away from work and give him the time he so much deserves.
