Animal Aid, is a non-profit, no-kill animal rescue shelter and adoption center in Boca Raton. The shelter takes in emergency, abuse and neglect cases as well as dogs and cats from various animal control agencies in Palm Beach, Miami-Dade and Broward Counties in South Florida. Animal Aid offers cats and dogs for adoption 7 days a week.

Threshold Inspections are performed on a threshold building in accordance to a structural inspection plan prepared by the structural engineer or architect of record.  These inspections are a law in Florida and are part of the Florida Statute under section 553.71.  The definition of a threshold building is any building which is greater than 3 stories or 50 feet in height, or which has an “Assembly” occupancy classification that exceeds 5,000 sq. ft. in area and an occupant content of greater than 500 persons.  In addition, the owner of a building which does not meet these minimum requirements, may designate his building as a threshold building, subject to more that the minimum number of inspections required.  To perform these inspections you need a licensed engineer or architect with a certification as a “Special Inspector” of threshold buildings and the Board of Professional Engineers and of Architects has a list of all these inspectors.

Who or what agency requires it?

The enforcing agency shall require that a special inspector perform the structural inspections for these buildings (see Florida Building code section 109.3.6).   The cost of these inspections shall be paid by the fee owner of the building.

 

Who typically is responsible for calling the inspections?

The contractor is typically required to call all inspections to the special inspector and to the building department.  Always verify with the building department as to their follow-up procedures prior to covering any are to be inspected.

 

Who does the inspections?

The special inspector can use an Authorized Representative to perform the day to day inspections.  This representative shall have qualifications that include licensed engineer or architect, graduation form a related engineering or architectural program, successful completion of the National Council of Examiners for Engineering and Surveying (NCEES) Fundamentals examination, a Florida licensed general contractor, or a Florida licensed Building Inspector.

 

What are additional inspection requirements of a threshold building?

All shoring and reshoring procedures, plans and details shall be submitted to the building department for record keeping.  Each shoring and reshoring installation shall be supervised, inspected, and certified to be in compliance with the shoring documents by the contractor.

 Legal Tips:  When Do I Hire an Attorney?

Contractors, subcontractors and suppliers often wait until it’s too late to consult an attorney.  Why you ask?  Attorneys cost too much, they only complicate things, they are bloodsuckers, sharks, etc.  I am sure you have a few reasons of your own to add to the list.  The fact is that WE ARE NOT THE ENEMY.  We are here to help protect and enforce your legal rights.  Too many people wait until they are in a lawsuit or have a collection matter to call an attorney.  Although we can help you at this point, the best plan is to be prepared.  Call your attorney before signing a contract.  The “right” contract can help save you tens of thousands and the “wrong” contract can cost you much much more. 

As an example, did you know that you don’t get attorney’s fees if you file a lawsuit for breach of contract unless it is contained in the agreement?  Many people think that just because you file a lawsuit and win, that you are entitled to attorneys’ fees.  In some limited cases certain laws allow recovery of attorney’s fees to the winning party and fortunately certain of those laws apply to some construction lawsuits.  What are the chances of litigation on a construction project?  Look around and you will see the countless lawsuits to collect on construction projects.  An ounce of prevention is truly worth a pound of cure.

There are two primary purposes of the construction lien law: (1) to protect the owners by requiring subcontractors to provide notice of possible liens, thereby allowing owners to prevent double payment for the same labor, services or materials; and (2) to protect lienors by assuring them of full payment.

If you are the owner of a property that is the site of a construction project, one way to limit your exposure to the individuals and companies working on the project is to make “proper” payments during the course of construction. The proper payments defense limits an owner’s liability for liens to the contract price. In practice, this defense means that if the owner fulfills its obligations under construction lien law, its liability for liens will not exceed the contract price.

Keeping in mind that a lienor has ninety days from the date of its last work in which to record a claim of lien, there are three steps an owner should take in order to position itself to assert the proper payments defense.
